Terms of Service

Last updated 13 October 2026

These terms cover your use of klickmind.com and, unless a signed agreement says otherwise, the services Klick Mind provides. By using the site, booking a call or hiring us, you agree to them.

The short version

  • This site is for businesses and adults (18 or older).
  • Every engagement starts with a written agreement. If it differs from these terms, the agreement wins.
  • Fees are paid by invoice and are non-refundable.
  • Monthly services can be stopped by either side with 30 days’ notice by email.
  • We commit to the work we agree to. We cannot promise business results.
  • Indian law applies.

About us and these terms

Klick Mind is the trading name of KlickMind, a sole proprietorship established in India (“Klick Mind”, “we”, “us”, “our”). “You” means the person using this site, or the business that hires us together with the person who accepts these terms on its behalf. If you accept these terms for a business, you confirm that you are authorised to do so.

These terms apply to your use of klickmind.com (the “site”) and, unless a signed agreement says otherwise, to the services we provide.

Who may use the site

You must be at least 18 years old to use this site, book a call, opt in to our text messages or hire us. Our services are for businesses, not for personal or household use.

Our services

We design, build and run follow-up systems, advertising, landing pages, automations, dashboards and other custom software for businesses. Descriptions on this site are general. The scope, deliverables, timeline and fees for your work are set out in a written proposal, order, statement of work or agreement that we both accept (your “Agreement”). If your Agreement differs from these terms, your Agreement wins.

Calls and bookings

Introductory calls are free and create no obligation for either side. You can reschedule or cancel using the link in your confirmation email. Anything we say on a call is general information and becomes a commitment only when it is written into an Agreement.

Fees, invoices and taxes

  • Fees are set in your Agreement and are paid by invoice, in US dollars unless the invoice says otherwise, by the due date shown on the invoice.
  • Fees do not include taxes. You pay any taxes that apply to our services, other than taxes on our income.
  • Advertising spend is paid by you directly to the advertising platforms unless your Agreement says otherwise.
  • If an invoice is overdue, we may pause work after telling you by email, and resume once it is paid.

No refunds

All fees are non-refundable, including fees for a partial month and for work already started, unless your Agreement expressly says otherwise or the law requires a refund. If you stop a monthly service, the notice period below applies and fees for that period remain due.

Term and cancellation

Unless your Agreement says otherwise, monthly services continue from month to month, and either of us can end them by giving 30 days’ written notice by email.

We may end services immediately by email if you seriously breach these terms or your Agreement, do not pay an overdue invoice after a reminder, or ask us to do something unlawful.

When services end, you pay for work up to the end date. Within 30 days of your request, we give you copies of the templates, content and records we built for you that are in our control.

Your responsibilities

  • Give us accurate information, timely approvals and the access we need to your accounts and software. Keep your own passwords secure, and remove our access when services end.
  • Make sure you have the right to share any data, content, logos and customer lists you give us.
  • Contacting your customers. Before we send text messages, calls or emails to your customers on your behalf, you are responsible for having the consent the law requires, including under the US Telephone Consumer Protection Act, the CAN-SPAM Act and state laws. We message only people with documented consent, and we may refuse or stop any message we believe is unlawful.
  • Your advertising accounts, websites and software remain yours, and your use of them is subject to those platforms’ own terms.
  • Do not send us patient health records, payment card numbers, government identification numbers or similar sensitive data unless your Agreement expressly covers it.

Other companies’ platforms

Our work often runs on other companies’ platforms, such as GoHighLevel, Meta, Google and the software you already use. We are not responsible for their outages, price or policy changes, account reviews, suspensions or ad rejections. Your use of them is governed by their own terms.

Results

Marketing and sales results depend on many things we do not control, including your market, offer, prices, team and how your customers behave. We do not promise any number of enquiries, bookings, sales or revenue. Figures on this site describe our past work and are not a forecast for your business. What we commit to is the work set out in your Agreement.

Intellectual property

This site. We own this site and its content, except third-party names and logos, which belong to their owners. You may view and print pages for your own use. Do not copy, resell or republish them without our written permission.

Work we do for you. Once you have paid for it in full, you own the content, templates and materials we create specifically for you, and your business data remains yours. We keep ownership of our own tools, code libraries, methods and know-how that existed before your work or were developed independently, and we grant you a non-exclusive, perpetual licence to use any of them that are built into your deliverables, for your own business.

Naming you as a client. Unless you tell us otherwise in writing, we may name your business as a client and describe our work in general terms, without disclosing your confidential information.

Confidentiality

Each of us will keep the other’s non-public business information confidential and use it only for our work together. This does not apply to information that is already public, was known before it was shared, is lawfully received from someone else, or must be disclosed by law.

Using the site

When you use this site, do not:

  • break the law or anyone else’s rights;
  • submit false information, or someone else’s details without their permission;
  • try to access our systems or accounts without permission, or interfere with how the site works;
  • upload malicious code, or copy the site’s content in bulk by automated means.

Text messages

If you agree to receive text messages from us, our SMS Terms apply. You can reply STOP to any message to opt out.

Privacy

Our Privacy Policy explains how we handle personal information, and our Cookie Policy explains the cookies used on this site.

Disclaimer of warranties

The site and its content are provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the site will be uninterrupted, secure or free of errors.

Limitation of liability

To the fullest extent the law allows:

  • neither of us is liable to the other for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill;
  • our total liability for all claims relating to the site, these terms or our services is limited to the fees you paid us in the three months before the event that gave rise to the claim, or USD 100 if you have not paid us anything.

These limits do not apply to fraud, or to any liability that cannot be limited by law.

Indemnity

You will defend and compensate us against claims by third parties arising from content or data you give us, messages sent to your customers on your instructions, your breach of these terms or your Agreement, or your breach of any law.

Events outside our control

Neither of us is responsible for a delay or failure caused by events outside reasonable control, such as natural disasters, power or internet failures, platform outages, or government action. The affected party will tell the other promptly and resume as soon as it can.

Governing law and disputes

These terms, your use of the site and our services, and any dispute about them are governed by the laws of India. If a dispute arises, we will first try to settle it in good faith by email within 30 days. If it is not settled, the courts of India have exclusive jurisdiction.

Changes to these terms

We may update these terms. The version on this page applies from the date shown at the top. Changes do not alter an Agreement that is already signed unless both of us agree in writing.

General

  • These terms, your Agreement and the policies linked from this page are the whole agreement between us about their subject.
  • If any part of these terms is found unenforceable, the rest still applies.
  • If we do not enforce a right straight away, we can still enforce it later.
  • You may not transfer your rights under these terms without our written consent. We may transfer ours to a successor of our business.
  • Notices under these terms may be sent by email. Notices to us go to [email protected].
